The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.16 dated 4.6.2018 registered for the offences under Sections 409 and 120-B IPC and Section 13(1)(c) and (d) read with Section 13(2) of the Prevention of Corruption Act, 1988 at Police Station Vigilance Bureau Ferozepur Range, Ferozepur. Cr. Misc. No.M-26700 of 2018 [2] Ms. Monika Jalota, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and have gone through the record.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the allegations in the FIR, the Malkhana of Police Station Vigilance Bureau Ferozepur Range, Ferozepur was inspected on 20.2.2018, and on checking of register No.19 it was found that cash of `1,01,195/- including `8,000/- of trap money, one gold ring, one bracelet silver, two silver rings, two mobile phones, 24 watches, two rings, 78 bags rice, one motor switch etc. were missing.
Learned counsel for the petitioner argued that the petitioner has not misappropriated any amount or any article. 70 Bags of rice were lying in the open etc.
Keeping in view the allegations against the present petitioner and the facts and circumstances of the present case, I find that the petitioner is required for custodial interrogation as recoveries are yet to be effected. Therefore, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail and accordingly, finding no merit in this petition, the same is dismissed.
