***** ARUN MONGA, J. (ORAL) Present petition has been filed under Section 438 of Code of Criminal Procedure, 1973 (for short 'Cr. P.C.') for grant of anticipatory bail to the petitioner in case FIR No.29 dated 05.04.2022, registered under Section 21(1) of Mines and Mineral (Development and Regulation) Act, 1957, at Police Station Hariana, District Hoshiarpur. 2.
Learned counsel for the petitioner submits that pursuant to earlier order dated 21.04.2022 passed by this Court, petitioner has joined the investigation and has fully cooperated in the same.

Learned State counsel per his instructions from ASI Madan Singh submits that petitioner has joined investigation and in view of cooperation rendered by him, no custodial interrogation of petitioner is required, however, there are other cases pending against the petitioner.

In view of the above, as far as this case is concerned, since custodial interrogation of petitioner is no more required, and he has already joined investigation and cooperated with the investigating officer, present petition is allowed. Order dated 21.04.2022 granting interim anticipatory bail to the petitioner is made absolute, subject to petitioner's complying with provisions under Section 438(2) Cr.P.C. However, prosecution/State is at liberty to proceed against petitioner in other cases, in accordance with law.
