(Oral) Faced with the situation that the substantial prosecution evidence has already been led, learned counsel for the petitioners seeks to withdraw the instant petition at this stage.
Ordered accordingly.
At this stage, learned counsel for the petitioners has submitted that petitioners no. 2 and 3 are aged 70 years and 69 years respectively and hence they may be granted exemption from personal appearance before the concerned Court.
Accordingly, the petitioners are granted exemption from personal appearance before the concerned Court subject to the following conditions: - (i) They will be represented by a counsel;
(ii) They will not delay/stall the proceedings of the trial Court;

CRM-M-16258 of 2022 (iv) They will have no objection if the prosecution evidence is recorded in their absence but in presence of their counsel;
(v) They will appear before the trial Court as and when required by the trial Court and any other condition which the trial Court may impose.
The petitioners shall file affidavits before the concerned trial Court stipulating above conditions.
