The petitioner seeks grant of anticipatory bail in respect of a case registered against him under Section 379 of Indian Penal Code. The allegations in nutshell are that Manoj - complainant alleged that his motorcycle bearing registration No. PB-35B-2729 was stolen by some unknown person and despite efforts made by him to search for the same, the same could not be found. It is not in dispute that the motorcycle in question has already been recovered by the police. It is also not in dispute that the other accused namely Kamal Kumar Mehra, who is identically situated, has been granted anticipatory bail by the learned Sessions Judge, Pathankot vide order dated 15.6.2018.
In view of the fact that recovery has already been effected and also on grounds of parity, the application merits acceptance and is hereby accepted.
In the event of arrest, the petitioner shall be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the Kamal Kumar 2018.07.06 10:19 I attest to the accuracy and integrity of this document
(2) CRM-M No.26733 of 2018 arresting Officer. The applicant is however directed to appear before the Investigating Officer as and when directed and cooperate with the investigation and abide by the conditions as provided under Section 438(2) Cr.P.C.
