This is an application for preponement.

Since the main case itself is listed for hearing today, the present application is dismissed as having been rendered infructuous. FAO No.2804 of 2019 (O&M) 3.

Learned counsel for respondent No.3-Insurance Company states that the matter had been referred to the Lok Adalat and before the Lok Adalat though the LRs of the appellant were not present, however, a statement was made by counsel for respondent No.3-Insurance Company that the Insurance Company was willing to settle the matter for an amount of Rs.8 lakhs, including interest, over and above the amount awarded by the Tribunal.

Learned counsel for the LRs of the appellant states that though before the Lok Adalat they were not present, however, they are now ready and willing to accept the offer as given by the Insurance Company and JITENDER KUMAR 2023.05.09 09:54 I attest to the accuracy and integrity of this order/judgment.

FAO No.2804 of 2019 (O&M) 2023:PHHC:066096 -2would be satisfied if the amount of Rs.8 lakhs, inclusive of interest, is paid to them over and above the amount awarded by the Tribunal. 5.

Learned counsel for respondent No.3-Insurance Company, on instructions, states that the Insurance Company is still willing to honour the offer made and would have no objection if the present appeal is disposed off in the said terms.

In view of the statement made by learned counsel for the parties, the present appeal is disposed off in the following terms : "Respondent No.3-Insurance Company shall hand over a cheque amounting to Rs.8 lakhs in the name of the legal representatives of the appellant within a period of three weeks from today and the said amount would be apportioned equally between the legal representatives of the appellant."

In view of the fact that the above appeal is disposed off in the above terms, pending applications, if any, also stand disposed off. Whether reportable: YES/NO JITENDER KUMAR 2023.05.09 09:54 I attest to the accuracy and integrity of this order/judgment.
