(ORAL) In the present petition, the grievance which is being raised by the petitioner is that a charge-sheet which was issued to the petitioner on 29.02.2012 (Annexure P-1) is not being taken to its logical end by the respondents despite the fact that the petitioner has retired from service and the pensionary benefits of the petitioner are being withheld by the respondents.

Learned counsel for the petitioner submits that the similar allegations were alleged by the respondent before the criminal Court, where the petitioner has already been found innocent as the cancellation report was submitted by the Investigating Agency and the respondents are keeping the disciplinary proceedings pending, and the same is causing prejudice to the SATYAWAN 2022.04.26 15:59 I attest to the accuracy and authenticity of this document

CWP-8288-2022 petitioner as the pensionary benefits of the petitioner have been withheld. Notice of motion.

On asking of the Court, Mr. Raman Kumar Sharma, Addl. A.G., Haryana, accepts notice on behalf of the respondents. Learned State counsel submits that the disciplinary proceedings initiated in pursuance to the charge sheet dated 29.02.2012 (Annexure P-1), if not already concluded, the same would be concluded within a period of four months from the date of receipt of this order. The learned counsel appearing on behalf of the petitioner submits that keeping in view the above mentioned statement of the learned State counsel, no further grievance of the petitioner survives in the present petition and the same may kindly be disposed of as having been not pressed any further at this stage.

Ordered accordingly.

It is directed that after the conclusion of the disciplinary proceedings, whatever the petitioner is found entitled for, the same be released to him within a period of eight weeks thereafter.
