The present appeal pertains to the year 1997. Vide order dated 16.12.2023 notices were issued to the parties. As per the service report, notice issued to the appellant No.1 has been received back unserved with the report that he has gone abroad. Appellant No.2 has died. Respondent No.1 and 2 stand duly served. Neither anybody has appeared on behalf of the appellant No.1 nor anyone has put in appearance on behalf of the legal representatives of the appellant No.2. In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 2.

Dismissed for non-prosecution with liberty to the appellant to get the same revived in case anything survives therein. Pending applications, if any, also stand disposed off.
