It is not disputed that respondents 2 to 4 are owners of the land in question which forms basis of an agreement to sell between them and the present petitioner. It is stated that the petitioner/ proposed vendee had paid a sum of Rs.36 lacs as earnest money at the time of execution of agreement to sell and since respondents 2 to 4 retracted from executing the sale deed, it is alleged that there was an intention to illegally grab the huge amount of money.

After hearing the learned counsel for the petitioner, this Court finds no ground for cancellation of bail. The learned Court below in view of the fact that the said RAJINDER PRASHAD JOSHI 2015.09.01 16:42 I attest to the accuracy and authenticity of this document High Court, Chandigarh.

CRM-M 25792/2015 respondents are true owners and merely because they have backed out from performing their part of the contract, the civil dispute cannot be extended the colour of criminal liability, granted bail to accused respondents 2 to 4.
