ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of regular bail under Section 439 of the Code of Criminal Procedure (in short 'Cr.P.C.') in FIR No.46 dated 14.07.2011, for offence punishable under Sections 379 and 411 of the Indian Penal Code, 1860 (in short 'IPC') registered in Police Station Sadar, District Mansa.
Counsel for the petitioner has submitted that the petitioner was initially declared as proclaimed offender on 19.09.2015 and on 04.04.2017 he has surrendered before the police and since then, he is in judicial custody. It is further contended that the case is triable by the Court of Magistrate and it will take long time in conclusion for trial. Learned State counsel has placed on record the custody certificate today in the Court and has not disputed the fact that the petitioner is in judicial custody since 04.04.2017 and has already undergone 03 months and 20 days of the custody. CRM No.M-25830 of 2017 Considering the fact that the trial of the case was delayed on account of the P.O. proceedings initiated against the petitioner, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court on payment of cost of Rs.5,000/- to be deposited with the District Legal Services Authority.
