In compliance of the order dated 18.01.2024, notices were sent to the parties. Aa per the report received, sole appellant has expired. His counsel Mr.Satbir Singh, could not be contacted as no enrollment number is available on the case file or vakalatnama. Out of six contesting respondents, five of them have expired whereas, respondent No.3 is duly served through his wife. Mr.P.P Doabia, Advocate, for the respondent has also been informed. However, nobody has put in appearance even for the respondent. 2.

No application is moved to implead LRs of the appellant. 3.

It appears in all the circumstances that appellant is no longer interested in pursuing the appeal. Otherwise also, perusal of the file would reveal that suit filed by the appellant along with proforma respondents seeking a decree of permanent injunction was dismissed by the trial Court with special cost on 02.08.1994 and the appeal filed by them was dismissed by the First Appellate Court on 25.02.1997 and thus, this appeal was filed against the concurrent findings, dismissing the suit for permanent injunction. 3.

All the aforesaid facts indicate that appellant or his LRs is no longer interested in pursuing the appeal and as such, the same is hereby dismissed in default for want of prosecution.
