RAMENDRA JAIN, J. (ORAL) The case has been taken up for hearing through video conferencing.
Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Gurjant Singh @ Jantu - in case arising from FIR No.86 dated 08.06.2019 registered under Sections 15, 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Dhanaula, District Barnala. According to the prosecution, on 08.06.2019, 500 kilograms of poppy husk was recovered from truck bearing registration No.PB-65-D7371 and Zen car bearing registration No.DL-03-CZ-5241, being travelled by petitioner and his co-accused.
Learned counsel inter alia contends that petitioner was only a labourer to load and unload the goods from the vehicles. He was not apprehended with conscious possession of the aforesaid contraband. RAVINDER SINGH 2020.06.29 14:25 I attest to the accuracy and integrity of this document
-2CRM-M-13638 of 2020 Petitioner is in custody since 08.06.2019. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more.
On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.
Since, huge quantity of 500 kilograms of poppy husk, which falls under the category of "commercial quantity", has been recovered from petitioner and his co-accused, who were apprehended at the spot, therefore, this Court is not inclined to grant regular bail to the petitioner. Dismissed.
