**** RAJ MOHAN SINGH, J. (Oral) Petitioner has preferred this petition for issuance of an appropriate writ, especially in the nature of mandamus, directing the respondents to release the due payment of Rs.16,93,300/- alongwith interest qua the work done by the petitioner.

Petitioner is a Government Contractor. The work of periodical Repair of Plan Road Bagrian to Mimsa up to Block Boundary was allocated to the petitioner, vide work order dated 15.02.2021. The petitioner has successfully completed this work on 20.04.2021 and payments of 1st and 2nd running bills have also been released to the petitioner, but the payment of final bill amounting to Rs. 16,93,300/- has not been released to the petitioner till date. Precisely, for the claim in question, petitioner has served a legal notice dated 17.03.2022 upon respondent No.5. At this stage, learned counsel for the petitioner submits that the petitioner would be satisfied in case its legal ANITA DEVI 2022.04.22 17:19 I attest to the accuracy and integrity of this document

CWP No.8018 of 2022 -2notice dated 17.03.2022 is ordered to be decided by respondent No.5 within a specified period in accordance with law. Notice of motion.

On asking of the Court Mr. C.L.Pawar, Sr.DAG, Punjab accepts notice on behalf of the respondent. In view of nature of order which this Court proposes to pass, there is no necessity of calling upon response from the respondent at this stage, as no order prejudicial to the interest of any party is being passed.

This writ petition is disposed of with a direction to respondent No.5 to decide the legal notice of the petitioner dated 17.03.2022 in accordance with law preferably within a period of one month from the date of receipt of certified copy of this order.

If the entitlement of the petitioner is established with reference to record, then the payment be released to the petitioner forthwith. Any delay in disbursing the payment shall result in imposition of interest @ 6% per annum for the delayed payment from the date of accrual till final realization of the same.
