**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioner seeks bail pending trial in FIR No. 502 dated 20.12.2014 under Section 307 IPC, registered at Police Station Sector-11 Chandigarh.

Learned counsel for the petitioner submits that petitioner has got admission in Dogra Law College, Jammu, and if he is not released on bail at this stage, he will be expelled from the college, which will cause serious prejudice to his academic career. He prays for allowing the present petition.

Learned counsel for U.T.Chandigarh, on instructions from SI Charanjit Singh, submits that out of total 16 witnesses, 15 have already been examined and the next date of hearing before the learned trial court is 18.8.2015. Thus, trial is about to conclude and petitioner is not entitled for the concession of bail pending trial, at this stage. He prays for dismissal of the present petition. CRM-M-25850 of 2015 (O&M) Having heard the learned counsel for the parties, after careful perusal of the record of the case and giving thoughtful consideration to the rival contentions raised, this Court is of the considered opinion that in the given fact situation of the present case, petitioner has not been found entitled for bail pending trial. It is so said, because earlier petition filed by the petitioner under Section 439 Cr.P.C. bearing CRM-M-19429 of 2015 was dismissed by this Court on merits, only on 2.7.2015. The FIR was registered just on 20.12.2014. There is no delay in trial on the part of the prosecuting agency.

In view of the above and without commenting any further on the merits of the case, lest it should prejudice the rights of either of the parties, no case for bail pending trial has been made out. Dismissed.
