Mr. Varun Sharma, Advocate, for the petitioner Mr. P.S.Paul, DAG, Punjab, for the respondent Fateh Deep Singh, J. (Oral) Learned counsel for the petitioner submits that as per the instructions of his client, he is not willing to enter into any sort of compromise with the complainant.

The allegations against Bikramjit Singh in this anticipatory bail are that from 12.4.2014 to 17.5.2014, the petitioner along with his coaccused non-applicant have duped the complainant on the pretext of sending him to England and in the process took a sum of Rs 5.5 lacs which the petitioner had received after the complainant had withdrawn the same from his bank account.

Though on behalf of the petitioner, Mr. Sharma has sought to aver that there has been inordinate delay in lodging the FIR which is almost two years and that it was not the petitioner who has received the amount and in fact it was the co-accused who has since been arrested and released on regular bail.

Criminal Misc. No. M-26768 of 2016 -2The averments of the learned State counsel are that custodial interrogation of the petitioner is essential to make recovery of the amount in question.

Having regard to the stand of the State and the allegations so levelled against the petitioner and in view of seriousness of the offence and the fact that custodial interrogation of the petitioner is essential, without adverting to the merits of the case, the present petition is dismissed.
