(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.136 dated 26.09.2013, registered under Sections 420 and 120-B IPC at Police Station Division No.2, Ludhiana (P-2) and all subsequent proceedings arising therefrom, on the basis of compromise (P-3).
Pursuant to order dated 28.03.2019 of this Court, the parties appeared before the trial Court on 09.05.2019 along with receipts of `15,000/- to get their statements recorded. Learned Judicial Magistrate Ist Class, Ludhiana, has submitted his report vide letter bearing No.348 dated 17.05.2019 duly forwarded by learned District and Sessions Judge, Ludhiana, vide letter bearing No.443/EC dated 18.05.2019. CRM-M-13999 of 2019 --2-- According to the report, ld. Judicial Magistrate Ist Class, Ludhiana, is satisfied that compromise has been voluntarily effected between the parties. The compromise appears to be genuine and without any pressure or coercion. No accused has been declared as proclaimed offender.
Considering the report of ld. Judicial Magistrate Ist Class, Ludhiana, dated 17.05.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.136 dated 26.09.2013 along with all subsequent proceedings arising therefrom, is quashed qua the petitioner only.
Disposed of accordingly.
