Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.103 dated 31.05.2017 under Section 306 read with Section 34 IPC, registered at Police Station Basti Bawa Khel, District Jalandhar.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that FIR has been got registered by one Deepak Kumar aged about 21 years. As per the FIR, one Kamal gave him abuses on phone. Then Kamal, Sunny Gujjar and Rajat asked the complainant as to why he went to Pardeep Rai, Councillor and they also told that many cases are pending against them and they would teach him a lesson. Even Rajat gave him threatening on phone. Being fed up with the threatening, Deepak Kumar consumed poisonous tablets used for keeping wheat.

The present petitioner is named in the FIR. Active role is attributed to him.

Keeping in view the facts and circumstances of the present case, nature and gravity of the offence, I find that petitioner is required for custodial interrogation and he is not entitled to benefit of anticipatory bail. Therefore, finding no merit in the present petition, the same is dismissed.
