Present appeal pertains to the year 1997. On the last date of hearing i.e. 19.07.2024, learned counsel appearing on behalf of the appellants had pleaded no instructions and in view thereof, notices were issued to the appellants.

As per office report, appellant Nos.1 and 6 are stated to have died. Appellant Nos.2 to 4 are stated to be not residing at the given address. Appellant Nos.5, 7 and 8 are stated to have refused to accept notice, however, affixation was made and hence, they are deemed to have been served. There is no other address of respondent Nos.2 to 4 except for the one as mentioned in the memo of parties as well as judgments of the Courts. None has come forward to be impleaded as legal representatives of appellant Nos.1 and 6.

Today also learned counsel appearing for the appellants pleads no instructions in the matter.

In view of the above, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 5.

Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
