On 6th of January, 2022, the following order was passed :- "Case heard by video conferencing "CRM-22915-2021 Vide this application, the petitioner seeks to implead the complainant in the FIR as a respondent in the accompanying petition, in terms of the directions issued by this court vide its order dated 23.04.2021.

The application is allowed. The complainant, i.e. Jagdev Singh, is ordered to be impleaded as respondent no.2 in the accompanying petition, with the amended memo of parties ordered to be taken on record.

CRM-M-17214-2021 Let notice be issued to the newly added respondent, returnable on 30.03.2022.

CRM-M-17214-2021 -2It is to be noticed that the learned State counsel submits that as per his instructions, out of the total amount of Rs.2 lakhs of which the complainant was allegedly defrauded, Rs.1,60,000/- have been paid to him.

Learned counsel for the petitioner submits that the petitioner would be willing to pay the remaining amount, i.e.Rs.40,000/-. That part would be considered upon the complainant putting in appearance.

Adjourned to 30.03.2022.

Today, Ld. Counsel for the petitioner has produced demand draft of Rs.40,000/- pursuant to order dated 6th of January, 2022. The same is handed over to counsel for respondent No.2/complainant (Mr. Arshdeep S. Brar, Advocate).

In view of the above, Ld. State Counsel submits that since the petitioner has already compensated the complainant for the alleged amount of Rs.2.00 lacs and by virtue of this, the matter has been settled amongst them, custodial interrogation of the petitioner is not required at this stage. 5.

Consequently, the order dated 23rd of April, 2021 is made absolute subject to the conditions enumerated under Section 438(2) Cr.P.C. September 12, 2022 (PANKAJ JAIN) Dpr JUDGE Whether speaking/reasoned :
