Prayer in this petition is for grant of anticipatory bail to the petitioners in FIR No.18 dated 24.01.2017 under Sections 376/385/506/120B/ 380/384/452 IPC and Sections 6 and 17 of the Protection of Children from Sexual Offences Act, 2012, registered at Police Station Sultanwind, Amritsar City District Amritsar.
It is submitted that the petitioners were found innocent by the police during investigation. They have been summoned to face trial in the abovesaid Omkar Singh 2018.02.02 17:50 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-2688 of 2018 -2FIR as additional accused on an application under Section 319 Cr.P.C. The petitioners, it is submitted, have appeared before the learned trial court on 29.01.2018 pursuant to interim order dated 23.01.2018 passed by this Court. It is submitted that the petitioners undertake to face proceedings and remain present before the learned trial court on each and every date fixed. It is thus prayed that this petition be allowed.
Copy of order dated 29.01.2018 passed by the learned trial court, produced in Court today, is taken on record subject to just exceptions. Learned counsel for the complainant as well as the State verify that the petitioners have appeared before the learned trial court. There are no allegations on behalf of the State that the petitioners are likely to abscond or that they are likely to dissuade the witnesses from deposing true facts before the Court, if released on bail. Keeping in view the facts and circumstances as above but without commenting upon or expressing any opinion on the merits of the case, this petition is allowed. Interim bail afforded to the petitioners be made absolute subject to their furnishing fresh bail bonds and surety to the satisfaction of the learned trial court.
It is clarified that none of the observations made hereinabove shall be construed to be a reflection on the merits of the case. The same are solely confined for the purpose of decision of the present petition. ( LISA GILL ) February 1 , 2018.
