The present appeal arises from a suit filed in the year 1993. The suit of the respondent was dismissed, whereas the appeal filed therefrom by the respondent was allowed. A coordinate Bench of this Court vide order dated 21.10.1997 had stayed the operation of the judgment and decree of the First Appellate Court which interim order has been continuing till date. 2.

None has appeared on behalf of the respondent. None has been appearing on behalf of the respondent.

Learned counsel for the appellants has submitted that in view of the same, the present appeal be disposed of but liberty be granted to the appellants to revive the same in case the respondent files for execution of the judgment and decree of the First Appellate Court or approaches the department to seek implementation of the judgment of the First Appellate Court.

Disposed of with the said liberty.
