HARINDER SINGH SIDHU, J Prayer is for grant of anticipatory bail in case FIR No.15 dated 13.01.2020 under Sections 420,120-B IPC and Section 24 of Immigration Act registered at P.S Salem Tabri, District Ludhiana. As per allegations, the petitioner along with co-accused had received an amount of Rs.2,50,000/- from the complainant on the promise to send him abroad. When the matter came up for preliminary hearing, learned counsel with a view to show his bonafide offered to deposit a sum of Rs.2,50,000/- before the learned trial Court and then the petitioner was granted the concession of interim bail and directed to join investigation. Learned State counsel, on instructions from ASI Janak Ram, states that the petitioner has joined the investigation.

Learned counsel for the complainant submits that not only the complainant has lost his hard earned money of Rs.2,50,000/- but he was also issued a dummy ticket by the accused because of which he was detained at Bangalore airport and an FIR was registered against him. Learned counsel for the petitioners states that though the entire MANOJ KUMAR 2021.09.

CRM-M-13720 of 2020 #2# amount of Rs.2,50,000/- received from the complainant was handed over to co-accused Amrik Singh but in the police investigation, it has been established that only a sum of Rs.1,30,000/- has been passed on by the petitioner to co-accused Amrik Singh agent.

Notwithstanding the above, learned counsel has offered that out of Rs.2,50,000/- deposited by the petitioner in the trial court, a sum of Rs.1,25,000/- be paid to the complainant unconditionally. The remaining sum of Rs.1,25,000/- may remain deposited before the learned trial Court to await the outcome of the trial.

Accordingly, it is directed that Rs.1,25,000/- out of the amount of Rs.2,50,000/- deposited by the petitioner before the trial Court be given to the complainant. The remaining amount of Rs.1,25,000/- shall remain deposited in the trial Court to await the outcome of the trial. In the light of aforesaid, the petition is allowed. The order dated 12.02.2021 directing the petitioner to join investigation, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by the conditions of Section 438 (2) Cr.P.C.
