Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.56 dated 19.04.2018 under Sections 307, 323 and 34 IPC, registered at Police Station Jandiala, District Amritsar.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that present petitioner is named in the FIR. He was stated to be armed with base ball bat. He gave injury with base ball bat on the left arm of the complainant, which has been declared as Vineet Gulati 2018.07.03 16:37 I attest to the accuracy and authenticity of this document Chandigarh grievous injury whereas co-accused has caused injury with iron rod on the
CRM No.M-26898 of 2018 -2left side of head of Yadwinder Singh. The petitioner has taken active participation in the commission of the offence and he was armed with weapon.
Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find that the petitioner is required for custodial interrogation.
Therefore, finding no merit in the present petition, the same is dismissed.
