(Oral) This petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to petitioner-Deepak Wadhwa in case FIR No.425 dated 26.05.2017 registered under Sections 406, 419, 420, 467, 506 read with Section 120-B IPC, at Police Station Saran Faridabad, District Faridabad.
Learned counsel for the petitioner submits that main accused, namely, Anil Sharma, against whom similar allegations are there, has approached this Court by way of filing Criminal Misc. No. M-2706 of 2018 and has been released on regular bail vide order dated 14.02.2018. Learned counsel further submits that the petitioner is neither beneficiary nor involved in such like offences. No other case is pending against the petitioner and nothing is to be recovered from him as challan has already been presented. The petitioner is in custody since 14.02.2018 and the trial may take some time to conclude. Criminal Misc. No. M-26904 of 2018 petitioner undertakes to appear on each and every date before the trial Court.
Learned State counsel has not disputed the custody period as well as the release of main accused-Anil Sharma on regular bail. Heard the arguments of learned counsel for the parties and have also perused the contents of FIR as well as other documents available on the file.
Keeping in view the submissions made by learned counsel for the petitioner and by claiming parity; the fact that main accused-Anil Sharma has been released on regular bail; the petitioner is in custody since 14.02.2018; no purpose would be served by keeping him in custody; and the trial may take some time to conclude, this petition is allowed and the petitioner (Deepak Wadhwa) is directed to be released on regular bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court.
