Petitioner seeks concession of pre-arrest bail in a case registered against her under sections 306/34 IPC whereby she has been summoned in exercise of powers under section 319 Cr.P.C. Learned counsel for the petitioner asserts that during investigation petitioner was found innocent. Complainant, thereafter, appeared in the witness box as PW1. On the basis of his statement, petitioner has been summoned to face trial. He submits that petitioner is ready to face trial. According to him, petitioner is not required for the purpose of investigation, thus, entitled to concession of pre-arrest bail.
Under the circumstances, petition is disposed of with the direction that in case she surrenders before the trial court within ten days from today, she shall be admitted to bail subject to conditions envisaged by section 438(2) Cr.P.C. or any other condition(s) deemed fit to be imposed by the trial court.
