*** As per report received from the trial Court, out of 12 prosecution witnesses 9 prosecution witnesses have been examined and two prosecution witnesses have been partly examined and the case is fixed for 9.5.2023. In that way, the trial is at the advanced stage and is expected to be concluded in near future. Thus no ground for grant of regular bail to the petitioner during pendency of trial is made out especially when the recovery involved is of commercial quantity attracting bar of Section 37 of the NDPS Act. Therefore, the present petition is dismissed. However, the trial Court is directed to make earnest endeavour to complete the trial by giving short adjournments, preferably within a period of three months from the date of receipt of copy of order there. Of course, counsel for the accused shall not seek any adjournment for cross-examination of Pws, who are present in the Court.
