ALKA SARIN, J. (ORAL) IOIN-RSA-1964-1997 1.

The present IOIN has been put up by the Registry for service of the parties inasmuch as vide order dated 13.05.1999 the matter was heard and reserved. Thereafter, the matter has been coming in the regular list without there being any order of admission.

As per the Office report, notices issued to the appellants as well as the respondents have been received back with the report that they have since died.

Accordingly, the present IOIN is disposed off and the main case is taken on board today itself.

The present appeal pertains to the year 1997. Vide order dated 20.11.2023 fresh notices were issued to the parties. RSA-1964-1997 (O&M) -2No one has come forward to get themselves implead as legal representatives of the deceased appellants. Further, learned counsel for the appellants states that he has no instructions in the matter.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 6.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
