(ORAL) Prayer in the writ petition is for issuance of a writ in the nature of mandamus directing the respondent No.2 to recommend name of the petitioner being next in merit, in view of letter dated 26.02.2019 (Annexure P-9) against the post of HCS (Executive Branch) in General Category after treating the unfilled vacant post earlier reserved for Special Backward Class Category to be of unreserved/General Category, in view of letter dated 05.03.2010 (Annexure P-10).
Learned counsel for the petitioner submits that petitioner will be satisfied if a direction is issued to respondent No.1-Chief Secretary to Government of Haryana to consider the representation dated 15.03.2019 (Annexure P-14) in view of Annexures P-9 & P-10 within a stipulated period.
Without going into the merits and demerits of the claim of the petitioner, I deem it appropriate to direct respondent No.1-Chief Secretary PANKAJ KUMAR 2019.10.18 14:31 I attest to the accuracy and integrity of this document
CWP No.8158 of 2019 (O&M) -2to Government of Haryana to consider the representation dated 15.03.2019 (Annexure P-14) in view of Annexures P-9 & P-10 within a period of two months from the date of receipt of certified copy of this order and pass a speaking order thereon, failing which respondent No.1 shall be liable to pay costs of `25,000/- to the petitioner. This condition of imposing costs is only to prevent petitioner running from pillar to post and avail remedy of contempt in case of non-compliance of directions issued by this Court. The writ petition stands disposed of with the above direction.
