The petitioner has filed this second petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.0001 dated 7.1.2016 registered for the offences under Sections 166, 167, 465, 466, 467 and 474 IPC at Police Station Qadian, District Batala. I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that the first anticipatory bail petition filed by the present petitioner has already been dismissed by the co-ordinate Bench of this Court vide order on 9.2.2016 passed in Cr. Misc. No.M-2758 of 2016. In that order, this Court has held that in view of the nature and gravity of the offences, no case for grant of anticipatory bail was made out. It is also in the order that custodial interrogation of the petitioner was required for completing chain of investigation to determine whether alleged Harpal Singh Parmar 2016.08.27 16:31 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-26908 of 2016 [2] discrepancies/forgeries were committed in connivance with the beneficiaries or not.
Keeping in view the above observations, the present petitioner is required for custodial interrogation and in view of the nature and gravity of the offences, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail. Therefore, there is no changed circumstances on these two points. Hence, this second anticipatory bail petition cannot be allowed.
Therefore, finding no merit in this petition, the same is dismissed.
