CRM-M-17281-2021 The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No. 78, dated 10.03.2021, under Sections 148, 149, 323, 342, 365, 506, 120-B of IPC, registered at Police Station Sadar Jhajjar.
Learned counsel for the petitioner submits that the petitioner has been in custody since 15th March, 2021 and only challan stands presented as on date. While drawing the attention of this Court to the allegations levelled in the FIR in question, it has been submitted that the petitioner has been attributed a blow with his belt on the soles of the feet of JAWALA RAM 2021.07.16 16:52 I attest to the accuracy and integrity of this document
CRM-M-17281-2021 (O&M) - 2 - the complainant. He further submits that the injuries attributed to the petitioner are simple in nature and even otherwise no such injury as alleged find reflected in the MLR (appended as Annexure P-6). He has apprised the Court that similarly situated co-accused Nitin @ Arun has been extended the concession of Bail vide order dated 25th May, 2021, of this Court. The submissions made by learned counsel for the petitioner, have gone un-controverted by the learned State counsel. She has, however, submitted that charges are likely to be framed in the near future. Heard.
In view of the submissions made by learned counsel for the parties and keeping in view the fact that the petitioner has been in custody since 15th March, 2021, I deem it a fit case for grant of the concession of regular bail to the petitioner, as the trial is unlikely to conclude in the near future, more so, in the prevailing conditions due to the outbreak of COVID19. The petition as such is allowed and the petitioner is admitted to bail to the satisfaction of trial Court/Duty Magistrate. However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case.
