Through this petition filed under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to the petitioner, in case FIR No.56 dated 05.02.2023 registered under Sections 147, 148, 149, 323, 341 and 506 IPC added Sections 342, 379-B and 384 IPC, P.S. Sadar Tauru, District Nuh.

On 27.03.2023 this Court passed the following order:- "Pointing towards the resolution dated 15.02.2023, Annexure P-3, Page-33, passed by District Bar Association, Nuh coupled with impugned order dated 17.03.2023 passed by Court below, learned counsel for petitioner inter alia submits that the petitioner was not able to pursue his case before the Addl. Sessions Judge, Nuh for want of appearance of his counsel resulting into dismissal of the bail application, in default. He also submits that, though, no specific injury has been attributed to petitioner, the petitioner is still ready to tender his unconditional apology to the complainant-victim.
Notice of motion for 22.05.2023.
In the meanwhile, petitioner will join investigation before the Investigating Officer as and when called. In the event of his arrest, the Arresting Officer would admit him to interim bail, till the next date of hearing, on his
2023:PHHC:076380 CRM-M-15530-2023 -2furnishing adequate bail and surety bonds to his satisfaction. The petitioner is also directed to abide by all the conditions as envisaged under Section 438(2) of Code of Criminal Procedure, 1973."

Learned State counsel on instructions from PSI Pardeep Kumar P.S. CIA, Nuh submits that in compliance of order dated 27.03.2023, petitioner has joined the investigation and is no more required for further interrogation.

Having considered the facts and circumstances of the case, order dated 27.03.2023 passed by this Court is made absolute, however, the petitioner shall deposit a sum of Rs.10,000/- with the District Bar Association, Nuh within a period of two weeks from today towards the library expenses.

Disposed of accordingly.
