(Oral) CM-4436-2025 This is an application for placing on record copy of letter dated 13.03.2025 as Annexure P-22 issued by the office of Station Election Commission, Haryana and copy of representation dated 19.03.2025 as Annexure P-23 sent by the petitioner to respondent No. 3 and exemption from filing certified/typed/translated/legible/fair copies of the same. For the reasons mentioned in the application, the same is allowed and Annexures P-22 and P-23 are taken on record. 1.

Prayer made in the present petition is for direction to the respondents to allow the petitioners to resume/conduct indefinite sit in protest.

A perusal of the writ petition would show that in pursuance to the order passed by this Court in CWP No. 4415 of 2025 disposed of on 20.02.2025, respondent No. 3 has passed an order dated 22.02.2025 whereby the request of Dharna demonstration was rejected in view of the fact that the elections of Municipal Corporation Gurguram and Manesar were to be held and Model Code of Conduct was enforced.

Learned counsel appearing on behalf of the petitioners submits that a perusal of the order dated 13.03.2025 Annexure P-22 would show that as result of the elections of the municipalities have been declared and Model Code of Conduct has ceased to be in operation as such, the petitioners may be permitted to hold protest.

Learned counsel for the petitioners submits that in fact the petitioners have submitted a representation dated 03.03.2025 Annexure P-21 wherein, request is being made for permission for peaceful protest and SitIn-Demonstration at the Dharna site. Another representation has also been submitted by the petitioners dated 19.03.2025 Annexure P-23, whereby, request has been made by the petitioners for deciding the earlier representation dated 03.03.2025.

Learned counsel for the petitioners submits that he will be satisfied at this stage, if a direction be given to respondent No. 3 to decide the representations dated 03.03.2025 and 19.03.2025 in a time bound manner.

Learned State counsel does not oppose the prayer as made by the petitioners.

In view of the facts mentioned above, the present writ petition is disposed of with a direction to respondent No. 3 to decide the

representations dated 03.03.2025 and 19.03.2025 within a period of 05 days from today with liberty to the petitioners to avail appropriate remedy in case, any action of the respondents, causes prejudice to the petitioners. 8.
