Tribhuvan Dahiya, J (Oral) The petition has been filed seeking a writ of certiorari quashing the order dated 29.02.2024, Annexure P-10, whereby the petitioners' candidature has been rejected by considering them ineligible for the post of TGT Sanskrit on the basis of their HTET certificate in subject area Social Studies.

Learned State counsel contends that due to inadvertence, the impugned order dated 29.02.2024 was passed without taking into account all the relevant facts including the law laid down in Civil Writ Petition No.26795 of 2016, titled Shikha Rani and another vs. State of Haryana and others. She also contends that the Commission has sought a clarification from the Government regarding the rule which stipulates that HTET certificate in Social Studies will not be considered for the post of TGT Sanskrit. On AVIN KUMAR 2024.04.01 17:01 I attest to the accuracy and integrity of this judgment/order.

2024:PHHC:042568 CWP No.7154 of 2024 [2] receiving the clarification, the impugned order will be reviewed in the light of law laid down and a fresh order will be passed. She has sought a month's time for the purpose.

Accepting the prayer, the second respondent is granted four weeks' time to pass a fresh order on the petitioners' representation. Till then, three posts of TGT Sanskrit (two general and one BCB category) as advertised vide advertisement No.2 of 2023, shall be kept vacant. 4.

Disposed of accordingly.
