PANKAJ JAIN, J. (ORAL) This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case F.I.R. No.24 dated 10.03.2021 registered for the offences punishable under Sections 307, 34 of IPC and Sections 25, 27 of Arms Act, 1959 (Section 326 IPC and Sections 54-59A of Arms Act added while submitting Challan) at Police Station Lambran, District Jalandhar, Punjab (Haryana).

Counsel for the petitioner submits that even though this Court ordered that the trial be expedited and concluded preferably within six months however the same could not be concluded within the stipulated time as prosecution could not conclude its evidence. 3.

State Counsel is not in position to dispute the aforesaid factual assertions based on record.

I have heard counsel for the parties and have gone through records of the case.

Without commenting on the merits of the case and recognizing the fact that the petitioner has a right to lead defence evidence, the present petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the Trial Court/Duty Magistrate concerned.
