RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Sanjay @ Sinha in case arising from FIR No.144 dated 20.12.2017 registered under Section 379-B IPC at Police Station GRP Hisar, District GRP Ambala Cantt. Learned counsel for the petitioner inter alia contends that the petitioner has been falsely arrested on the statement of one Baljeet. There is no direct evidence against the petitioner. He is in custody since 16.01.2018. The conclusion of trial will take a long time. On the other hand, learned State counsel vehemently opposed the bail application.
Considering overall facts and circumstances, but without expression any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds to the satisfaction of the Trial Court/Duty Magistrate concerned.
