(ORAL) This is a petition that has been filed for grant of anticipatory bail to the petitioner in case FIR No.22 dated 31.03.2021 registered under Sections 323, 326 read with Section 34 IPC at Police Station Block Majra, District SAS Nagar.

Learned counsel appearing for the petitioner would submit that the petitioner herein has been falsely implicated in the said case, as the dispute pertains to land measuring 6 kanals 04 marlas, which has been given to the petitoiner by the mother, Prem Kaur on the basis of a Will. It is submitted that there is a delay of 3 days in lodging of the said FIR. It is also submitted that mutation has been sanctioned in favour of the petitoiner by the Tehsildar. It is argued that pursuance to the order dated 22.04.2021, the petitioner has joined investigation.

CRM-M No.17104 of 2021 (O&M) -2pertaining to the mutation that has been entered by the Tehsildar, however, the petitioner herein has inflicted a grievous injury on the complainant. It is further submitted that the petitioner herein had aimed at the head of the complainant, however, little finger of right hand of the complainant had been amputated in avoiding injury by a sharp-edged weapon on his head. Learned counsel appearing on behalf State would submit that the petitioner had joined investigation, however, he has not cooperated in the said investigation nor handed over the weapon used for inflicting the grievous injury upon the complainant.

I have heard learned counsel for the parties and have perused the paper book. Even though the petitioner had been directed to join investigation, he has not cooperated with the investigating officer in handing over the weapon of offence. Since the petitioner has not cooperated with investigation, this Court does not deem it appropriate to confirm the order dated 22.04.2021 granting interim bail to the petitioner and the same stands vacated. The instant petition stands dismissed.
