The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in complaint case No.723 dated 23.12.2013 registered for the offences under Sections 323, 324, 326, 506 read with Section 34 IPC made before the Chief Judicial Magistrate, Palwal. Notice of motion has been issued in this case. Mr. Himmat Singh, learned Assistant Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Assistant Advocate General, Haryana appearing for the respondent-State and have gone through the record.

From the record, I find that as per the interim order the HARPAL SINGH PARMAR 2015.09.29 16:09 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-26064 of 2015 [2] petitioner has already appeared before the trial Court and he has been released on interim bail. The present petitioner has been summoned under Section 319 Cr.P.C. He is not required for investigation or interrogation purposes. Nothing is to be recovered from him. He has only to appear before the trial Court to face trial. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 7.8.2015 passed by this Court granting interim relief to the petitioner is made absolute. September 28, 2015.
