*** This is a petition for grant of interim bail to petitioner Sunita, who is an accused in case F.I.R. No. 04 dated 4.1.2018 under Sections 304B, 302, 34 IPC registered with Police station Kundli, District Sonepat. It is stated that the petitioner is suffering from serious ailment for which her emergency surgery is required. Though she is being given treatment in jail by referring her to BPS Govt. Medical College for Women, Khanpur Kalan but better treatment is available from private medical institutes, therefore, for removal of stones from her kidneys and fibroid in the uterus by way of surgery, as such she be granted interim bail. Notice of petition was given to the State. A detailed reply in the matter has been filed in which it is admitted that she is having stones of sizes 5mm x 6mm in kidneys and a fibroid in uterus and she is being regularly sent to BPS Govt. CRM-M No. 27068 of 2018 investigation and treatment. It has been reported that petitioner is very weak and anemic and regularly complains about abdominal pain. Mr. Satvinder Kumar Godara, Superintendent Jail, Sonepat along with Dr. Sanjeev Kumar, Medical Officer, District Jail, Sonepat are present in the Court today. The medical officer has stated as per the averments in the written reply filed. After hearing learned counsel for the petitioner and learned State counsel, I find that keeping in view the nature of ailment that petitioner is suffering, it would be proper and appropriate if she is granted interim bail to enable her to get surgery conducted from some private hospital. Dr. Sanjeev Kumar, Medical Officer, District Jail, Sonepat states that after surgery the petitioner would require 3-4 weeks time to recover.
As such petition for interim bail is accepted and the petitioner is ordered to be released on interim bail for a period of 2 months subject to her furnishing personal bond and surety bond to the satisfaction of the trial Court. The trial Court would accept the surety of a local person who is having sufficient immovable properties with documentary proof to ensure that petitioner does not abscond. The period of two months shall start from the date when the bonds are accepted by the trial Court. After expiry of that period, she shall surrender in District Jail, Sonepat.
The petition stands allowed accordingly.
