(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 425 dated 28.12.2015, registered at Police Station Jodhewal, District Ludhiana, who has been booked for having committed the offence punishable under Sections 417 / 376 IPC.

As per the statement of the prosecutrix P.W.1 under Section 164 Cr.P.C, she admitted that she accepted the offer of friendship of the petitioner and their friendship continued for 3-31⁄2 months and they were meeting daily. She further admitted that they made physical relations with their consent. But when she came to know about the marriage of the petitioner, she informed the police and the above said case was registered against the petitioner.

Crl. Misc. No. M-27003 of 2016 -2that after presentation of the challan and after framing of charges, out of 17 witnesses, 03 have been examined including prosecutrix. Petitioner is in custody since 28.12.2015.

Keeping in view the period of incarceration of the petitioner, this Court feels that there is no need to detain the petitioner any longer. Accordingly, the present petition is allowed.
