R.P. Nagrath, J. (Oral) Prayer in the instant petition is for grant of anticipatory bail under Section 438 Cr.P.C. in FIR No. 400 dated 16.10.2014 for offences under Sections 307, 323, 148, 149 and 188 of Indian Penal Code (IPC), Section 25 and 27 of the Arms Act and Section 134-B of Representation of Peoples Act, registered at Police Station Sirsa.
It is alleged that the petitioner exhorted his co-accused which result in causing injuries to Sandeep-complainant. The petitioner is also said to have caused injuries on the person of Brij Lal, which was found simple in nature. Two of the co-accused Munna and Nishan have been arrested and Gokul Setia is yet to be arrested and it is submitted that Gokul Setia is main accused. After hearing learned counsel for the parties, learned State counsel and without commenting on merits of the case, the instant petition is allowed with a direction to the petitioner to appear before the Investigating Officer/SHO of the Police Station JITENDER KUMAR 2015.08.25 10:14 I attest to the accuracy and integrity of this document
CRM-M-26097 of 2015 -2on 07.09.2015 between 11.00 a.m. to 02.00 p.m., who would admit him to bail on furnishing bail bonds to his satisfaction. The petitioner is also directed to keep on joining investigation as and when required and cooperate with the same. Any recovery made in pursuance to the disclosure statement would be admissible under Section 27 of the Evidence Act.
If the petitioner fails to appear before the investigating officer on the date and time stipulated above, the concession granted vide this order shall automatically stands vacated.
