RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Vakil Singh in a case arising from FIR No.253 dated 10.09.2016 under Sections 302 and 201 registered at Police Station Dabwali Sadar, District Sirsa. According to the prosecution, petitioner committed the murder of Gurditta Singh, who was Mahant of the Dera.

Learned counsel for the petitioner inter alia contends that the petitioner has been falsely implicated and arrested on the confession of the petitioner himself in police custody. There is no iota of evidence collected by the police against the petitioner that he committed the murder of Gurditta Singh. The petitioner is in custody since 13.09.2016. The conclusion of trial shall take a long time. No useful purpose would be served by detaining the petitioner in jail.

On the other hand, learned State counsel vehemently opposed Ravinder Singh 2017.10.13 11:06 I attest to the accuracy and authenticity of this document prayer for grant of regular bail.

-2CRM-M-26140 of 2017 Considering over-all facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds, to the satisfaction of Trial Court/Duty Magistrate concerned.
