The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.119 dated 11.6.2015 registered for the offences under Sections 307, 323, 333, 353 and 506 IPC read with Sections 147 and 148 of the Railways Act at Police Station G.R.P. Faridabad, District: GRP Ambala Cantt.
I have heard Mr. R.S. Rai, learned senior counsel assisted by Mr. Anurag Arora, Advocate appearing for the petitioner and have gone through the record.
From the record, I find that the present petitioner is named in the FIR and rather main motive for causing the occurrence is alleged against him. As per the FIR, complainant-Bir Singh received the injuries along with other persons. It is the case of the prosecution that the present petitioner HARPAL SINGH PARMAR 2015.08.14 16:34 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-26102 of 2015 [2] along with other accused have caused these injuries. As per medical report, Bir Singh has received three injuries dangerous to life on the vital parts of the body.
Keeping in view the nature and gravity of the offence and the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail.
Therefore, finding no merit in this petition, the same is dismissed.
