******* SURINDER GUPTA, J.(Oral) Present petitions have been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to petitioners in case FIR No. 199 dated 10.11.2012 registered for offences punishable under Sections 326/452/325/323/506/148/149/120-B of Indian Penal Code, at Police Station Adampur, District Jalandhar. (Offences punishable under Sections JITENDER KUMAR 2018.09.14 10:11 I attest to the accuracy and integrity of this document Chandigarh 450/459 IPC were added later on).
CRM-M-27103 of 2018 -2Heard.
Learned counsel for petitioners submit that applications seeking framing of charge for offence punishable under Section 460 IPC is still pending before the trial Court.
Above captioned petitions are disposed of with direction to trial Court to release petitioners on bail on furnishing bail bonds and surety bonds to its satisfaction, in the event of offence punishable under Section 460 IPC is found to be made out against them, subject to the following terms:- (a) Petitioners shall comply with the conditions mentioned in Section 437(3) Cr.P.C.
(b) In the event of their absence on any date of hearing, the benefit of bail allowed to petitioners shall stand withdrawn. The trial Court shall be competent to cancel their bail bonds and surety bonds and proceed to procure their presence in accordance with law. In that eventuality petitioners shall have to apply for bail afresh. (c) They shall not leave the country without the previous permission of the Court.
