The allegations against the petitioner-Bhupinder Singh @ Bhupi in this regular bail application under Section 439 Cr.P.C. are that on 14.4.2016 he along with his co-accused armed with dattars has assaulted the complainant side. The averments of the counsel for the petitioner that the injury attributed to the petitioner is on the back side of the head and is simple one and that the petitioner is in custody since 07 months are not controverted by the learned State counsel, who with all fairness conceded that there is no medical means to support that any injury attributable to the accused side is medically covered under the definition of "dangerous to life". In the light of the same and in view of the fact that applicability of Section 307 IPC is debatable issue and that trial is not likely to be concluded in near future and no useful purpose would be served by keeping Aarti Sharma 2016.11.26 13:25 I attest to the accuracy and integrity of this document
