******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioners in case FIR No.224 dated 24.11.2016 registered for the offences punishable under Sections 323, 324, 326, 452 read with Section 34 of Indian Penal Code (for short-IPC) (Section 326 IPC added later on), at Police Station Kotwali, District Kapurthala.
Heard.
Learned counsel for the petitioner submits that petitioners had filed application seeking pre-arrest bail before the Additional Sessions Judge, Kapurthala which was taken up on 14.07.2017 and was adjourned to 08.08.2017 but no interim relief was allowed to the petitioners. He further submits that in the case registered on the statement of sister of petitioner, no arrest has been made by the police.

On asking of this Court, Ms. Rajni Gupta, Senior D.A.G. Punjab, who is present in the Court, accepts notice on behalf of respondentState. Keeping in view the fact that matter is pending before learned Additional Sessions Judge, Kapurthala for 08.08.2017, as such, any observation made on merits will affect the matter pending there. This petition is disposed of with direction to learned Additional Sessions Judge, Kapurthala to take up the bail application of petitioners on 28.07.2017 or the next day and dispose of the same on merits. Copy of this order be supplied dasti to the petitioners, who will supply the same to the Court concerned by tomorrow. Petitioners be not arrested till 28.07.2017.
