The learned State counsel, on instructions imparted to him by the official concerned, submits, that Annexures P-4, P-5 and P-8 become uncontrovertedly passed by the District Mining Officer concerned, who is stated, at the bar, by the learned State counsel, to be lacking in jurisdictional competence to make the said annexures.

Consequently, the District Mining Officer concerned, is directed to forthwith transmit all the relevant details in respect of the relevant breaches being made vis-a-vis the terms and conditions of the licence granted to the mineral concessionaire concerned, to the Director Mines, who on receiving the said details along with the report of the District Mining Officer concerned, and, after assigning a show cause notice to the present petitioner, shall proceed to in accordance with law make a speaking decision on the relevant motion but within a period of one month from today.
