Respondent Nos.6 to 11 already proceeded ex parte vide order dated 10.12.1996.

The present appeal pertains to the year 1996. Vide order dated 11.03.2024 notices were issued to the appellants. As per the service report, appellant No.1 has died. Appellant No.2 stands duly served through affixation. Appellant No.3 remains unserved with the report that he is not residing at the given address. Appellant No.4 also stands duly served through wife. No one has come forward to get themselves impleaded as legal representatives of appellant No.1 nor any counsel has put in appearance on their behalf. None has put in appearance on behalf of appellant Nos.2 and 4 despite service. There is no other address available with the Court for effecting service of appellant No.3 except the one mentioned in the memo of parties and in the judgments and decrees passed by the Trial Court and the First Appellate Court and is the same on which the notice was sent. None has put in appearance on behalf of respondent Nos.1, 2, 3 and 5. Respondent No.4 has died.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 3.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications and IOIN, if any, also stand disposed off.
