**** ANITA CHAUDHRY, J (ORAL) Through the instant petition, the petitioner is seeking anticipatory bail in case FIR No. 54 dated 28.5.2018, registered under Sections 498-A, 406 IPC, Police Station Sujanpur, District Pathankot. Counsel for the petitioner states that pursuant to the order dated 18.7.2018, passed by this Court, the petitioner has joined the investigation. Both the parties are present. The petitioner wants to part ways. The complainant does not want to part ways and wants to live with the petitioner.

State counsel informs that the petitioner has joined the investigation and the household articles were recovered but no gold article was returned. State counsel also informs that no photograph of handing over the gold article was given to the police.

Crl. Misc. No. M-27158 of 2018 -2The complainant will have to prove the articles that were handed over and were not returned, at the trial. Looking to the circumstances, but without commenting on the merits of the case, the petition is allowed and order dated 18.7.2018 granting interim bail to the petitioner is made absolute subject to the conditions laid down in Section 438 Sub Section 2 Clauses (i)(ii) and (iii) of the Code of Criminal Procedure.
