The present writ petition lays challenge to the notice dated 11.05.2025 and the orders dated 09.06.2025 and 18.06.2025. Vide the impugned order dated 18.06.2025 passed by the respondent No.3-Principal of the Institute, the name of the petitioner, who was pursuing his Electrical Trade studies, has been struck off on the premise that he was found involved in objectionable and unsocial activities with a teacher/instructor of the Institute.

At the outset, learned counsel for the petitioner submits that a similar order terminating the services of the teacher/instructor, with whom the petitioner was allegedly found involved in objectionable and unsocial activities, was passed by the Institute. It is further submitted that the said termination order dated 30.10.2025 has already been set aside by a Coordinate Bench of this Court vide order dated 23.12.2025 passed in CWP35527-2025 (Manisha Bai vs. State of Haryana and others), with liberty to

the respondents to pass a fresh order in accordance with law after conducting an inquiry into the allegations of misconduct. It was further directed that, in the meanwhile, the said teacher/instructor be allowed to work on the terms she was working prior to the termination order. 3.

On the previous date of hearing, i.e. 11.03.2026, this Court had passed the following order:- "Through the instant writ petition, as cast under Articles 226/227 of the Constitution of India, challenge is thrown to the notice dated 11.05.2025 (Annexure P-1), and also the orders dated 09.06.2025 (Annexure P-2), and 18.06.2025 (Annexure P-3), on the ground of infraction of principles of natural justice. Learned counsel for the petitioner submits that the order of termination issued against an Instructor (Smt. Manisha Bai), qua the same occurrence, was assailed before this Court, by way of CWP-35527-2025. Accordingly, a Coordinate Bench, vide order dated 23.12.2025 (Annexure P-4), set aside the termination order, thereby, allowing her to work on the terms she had been working. Further, a direction was also issued to the respondents to pass a fresh order.

Notice of motion.

Mr. Bhupender Singh, learned Additional Advocate General, Haryana, accepts notice on behalf of the respondents, and waives service. He is directed to have apt instructions, and apprise this Court, as to whether, respondent No.3, in the light of the order dated 23.12.2025 (supra), is required to re-visit the matter or not? Adjourned to 24.03.2026.

In compliance with the directions enclosed in the hereinabove extracted order, learned State counsel appearing for the respondents, upon instructions from the quarter concerned, submits that the case of the petitioner is squarely covered by the order (supra) passed by the Coordinate Bench.

In view of the aforesaid fair submission made by learned State counsel, the impugned order is set aside, with liberty to the respondents to take appropriate action, in accordance with law, on the show cause notice, after conducting a proper inquiry into the allegations of misconduct. In the meanwhile, the petitioner shall be permitted to continue his studies with the respondent-Institute.
