The present appeal pertains to the year 1997. Vide order dated 21.12.2023 notice was issued to the appellant. As per the service report, sole appellant is stated to have died. None has appeared on behalf of the legal representatives of the appellant. Mr. Baljeet Beniwal, Advocate has put in appearance on behalf of the legal representatives of the respondent and has filed his memo of appearance, which is taken on record. 2.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 3.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
