AJAY TEWARI, J (ORAL) Prayer in the present petition is for grant of regular bail in case FIR No.87 dated 18.3.2014 under Sections 148,149,323,324,506,302,452 IPC, and Section 3 (2)(5) of the SC/ST Act, Police Station, Kalanaur. Learned counsel for the petitioner states that the petitioner is in custody since 26.5.2015. It is stated that the petitioner was originally granted bail on 18.2.2015. He appeared on the next date of hearing i.e 10.3.2015 but on 18.5.2015, the date for which the case was subsequently adjourned, he could not appear because of his illness. It is further stated that along with second application for bail, the petitioner had attached OPD card of the Government Hospital at Kalanaur.

Learned state counsel has accepted the factual submissions but states that seeing the propensity of the petitioner to abscond, if the bail is to be granted that should be subject to furnishing of heavy surety by the petitioner.

Request being fair is accepted.

Trial Court is directed to release the petitioner on bail subject to his furnishing heavy surety.

Petition stands allowed.
